Federal confidentiality regulations under 42 CFR Part 2, which govern substance use disorder (SUD) treatment records, may act as a barrier to information exchange for providers who treat Medicaid enrollees with opioid use disorder and other SUDs. In November 2017, MACPAC convened a roundtable of federal and state officials, health care providers, legal experts, Medicaid health plans, and patient advocates to better understand how these regulations affect care delivery and identify whether changes may be needed to promote integration without compromising patient privacy. This presentation provides an overview of the regulations and summarizes the themes of the roundtable discussion.
