Medicaid programs are required to recover assets from the estates of certain beneficiaries who used long-term services and supports as reimbursement for their care. Recovering such funds involves a number of steps to notify potential Medicaid beneficiaries of the policy, assess and verify assets, inform survivors of estate recovery claims, initiate recovery through the probate process or other means, and provide exceptions in the case of potential hardships.
This presentation provides background on Medicaid estate recovery policies, summarizes past research, and presents data on recoveries in fiscal year 2018. It also describes potential policy options and research for any future Commission work.
