State Medicaid programs must seek recovery of Medicaid payments for long-term services and supports from the estates of beneficiaries who were age 55 or older or permanently institutionalized at the time they died. Some states are also seeking recoveries for other types of services. This presentation provides background on Medicaid requirements for estate recovery, and raises issues about the consistency of policies to recover the costs of medical care with the Affordable Care Act’s new modified adjusted gross income (MAGI) and exchange subsidy eligibility policies, neither of which include asset tests.
