Federal law requires state Medicaid programs to seek recovery from the estates of deceased beneficiaries for payments for long-term services and supports (LTSS) and related services received when beneficiaries were age 55 or older or were permanently institutionalized. This presentation provided an update on MACPAC’s recent work on estate recovery, including a discussion of themes from stakeholder interviews. While estate recovery is a revenue source for states, stakeholders affirmed that it can negatively affect access to LTSS and raises equity concerns.
This presentation also provided background information, rationale, and implications for three draft recommendations for the Commission’s consideration. In January, staff expect to return with a draft chapter for the March report to Congress and Commissioners will vote on recommendations at that time.
