Review of Proposed Rule Affecting Integrated Care for Dually Eligible Beneficiaries

On November 1, 2018, CMS published a notice of proposed rulemaking related to Medicare Advantage and Part D.  The rule would also implement certain provisions of the Bipartisan Budget Act (BBA 2018; P.L. 115-123) affecting dually eligible beneficiaries. BBA 2018 established new requirements for integration of Medicare and Medicaid services in dual eligible special needs plans (D-SNPs) and directed CMS to unify grievance and appeals procedures across the two programs, to the extent feasible. D-SNPs are Medicare Advantage plans for which enrollment is limited to dually eligible beneficiaries.
